Jury Rules Qualcomm Infringed Three Broadcom's Patents

A federal jury has ruled unanimously that wireless technology company Qualcomm (News - Alert) Inc. infringed three of Broadcom patents, and awarded the communications company $19.64 million in damages.


 
Broadcomm is expected to seek a permanent injunction barring Qualcomm from further using the infringing patents, which cover simultaneous use of a single transceiver on two networks, a chip architecture to perform video processing, and technology that may be used to place calls over fixed or variable bandwidth networks.


 
"We are very pleased with the jury's verdict, and gratified that the jurors were able to absorb and evaluate very technical material and arrive at the conclusion that Qualcomm once again is improperly utilizing our patented technology covering cellular baseband solutions," said David Dull, Broadcom's (News - Alert) senior vice president and general counsel, in a statement.
 
The verdict, following a 13-day trial and two and a half days of deliberations, clearly indicates the tide has turned in favor of Broadcom in its two-year long patent dispute with Qualcomm.
 
In January, a San Diego federal court ruled Broadcom does not infringe two Qualcomm patents related to video compression. The judge decided that Qualcomm had waived its right to enforce the patents by failing to comply with its obligations to the applicable industry standards body. A hearing on the punishment for Qualcomm's conduct is slated for the end of June.
