Citizens for a Pro-Business Delaware Slams Skadden Arps After Law Firm Chooses to Pursue Costly Litigation Rather Than Accept Payment From TransPerfectMore than three years after completion of the unprecedented forced sale of TransPerfect, Chancery Court-appointed Custodian Bob Pincus from Skadden Arps and Skadden partner Jennifer Voss continue to threaten ongoing litigation and costly legal proceedings rather than simply accepting the money paid to them. A recent letter from Voss to TransPerfect's lawyers indicates that Skadden has refused to cash a more than $1.1 million payment made on behalf of the firm for outstanding debts owed due to unfounded accusations of "bad faith" and procedural hairsplitting. Said Citizens for a Pro-Business Delaware Campaign Manager Chris Coffey, "Skadden is facing an easy choice - cash the check already in their possession from TransPerfect and pay themselves, or nitpick and fight at every turn. It seems that Custodian Bob Pincus and his attorney Jennifer Voss are so accustomed to running roughshod through the Delaware courts that they are opting for the latter. "Already, Skadden and its advisors have charged TransPerfect an obscene $50 million-plus throughout the course of its custodianship, yet the firm continues to contst every procedural step as if the legal system will come crashing down if they receive money via a check rather than a wire. Only in Delaware would a well-connected law firm feel so entitled to reject a $1.1 million payment on procedural grounds rather than simply paying themselves. "We have worked for years to expose the casual entitlement that lawyers from Skadden Arps have exhibited while using the Chancery Court as their platform for charging companies exorbitant fees. This is just another example of Skadden Arps lawyers' committing highway robbery by misusing their Chancery Court influence thanks to the all-white revolving door of Delaware's bench and bar. We will continue to shine light on a judicial system that favors elite law firms like Skadden and alienates hard-working employees who are locked out of the decisions affecting their lives."
