Food Safety Law Firm Pritzker Hageman, P.A. Files First McDonald's Cyclospora Lawsuit in Iowa


The national food safety law firm, Pritzker Hageman, P.A., has filed the first lawsuit in Iowa against McDonald's corporation on behalf of J.H., who was diagnosed with a Cyclospora infection after eating contaminated food at a McDonald's restaurant. The lawsuit was filed July 18, 2018, in the Iowa District Court of Clarke County, Iowa (case number 05201LACV012551) by attorneys Brendan Flaherty and Ryan Osterholm.

"Cyclospora symptoms, including severe diarrhea, can last several months or longer," said attorney Brendan Flaherty, a national food safety lawyer. "Our client has suffered significant health issues because of this infection. We believe that this outbreak, including our client's illness, could have and should have been prevented."

The lawsuit alleges Plaintiff J.H. purchased food several times in late June of 2018 from the McDnald's located at 1220 Jeffreys Drive, Osceola, Iowa. In early July of 2018, J.H. began suffering severe cramping, diarrhea and fatigue, all symptoms of Cyclospora food poisoning. A stool culture tested positive for Cyclospora, a parasite that causes severe gastroenteritis in humans called cyclosporiasis. Symptoms of cyclosporiasis include watery diarrhea, loss of appetite, cramping, nausea, fatigue, fever, dehydration and weight loss.



The Iowa Department of Public Health confirmed that J.H. was part of the multi-state outbreak of Cyclospora caused by contaminated food products that were produced and sold by certain McDonald's restaurants, according to the lawsuit.

According to documents filed in this case, in late June of 2018, Illinois Department of Health and the CDC identified a spike in the number of cyclosporiasis cases in Illinois and Iowa. Public health investigators soon identified salads and other produce products sold at Defendant McDonald's restaurants as the likely source of the illnesses. As of July 13, 2018, the CDC had identified 61 Cyclospora outbreak cases in seven states: Illinois, Iowa, Minnesota, Missouri, Nebraska, South Dakota and Wisconsin.
