Trilogy Class Action Services: Canadian Court certifies a Class Action concerning the oral contraceptive, Alysena™ 28


The Alberta Court of Queen's Bench has certified a multi-jurisdictional class action on behalf of women who used Alysena™ 28 that was purchased in Canada between November 19th, 2012 and April 15th, 2013, as well as the biological fathers of children born to these women after those dates.

The class action concerns certain specific lots of Alysena™ 28 prescription birth control pills that were packaged in Spain by Laboratorios León Farma SA ("León Farma") and subsequently sold in pharmacies across Canada until they were withdrawn from the market in April of 2013.

The Plaintiffs, who are represented by Merchant Law Group LLP, claim that certain packages of Alysena™ 28 contained an insufficient umber of active tablets such that, when used as directed, Alysena™ 28 would not perform its intended contraceptive function. Class members claim to have experienced unintended pregnancies as a result, for which they claim the costs of raising children, loss of mobility, and pain and suffering relating to pregnancy, as well as other damages. The allegations in the class action have not been proven in court, and León Farma denies any wrongdoing.
