Rose Law Firm Says Aero Automatic Sprinkler Company Acknowledges "Underpayment of Wages" In Letters To Workers


Rose Law Firm says Aero Automatic Sprinkler Company, a subsidiary of Kiewit Corporation, admits in letters to its employees it found "payroll errors." According to Rose Law, although Aero denies wrongdoing, Aero acknowledged it discovered "underpayment of wages" to some workers as a result of its own investigation following a federal class action lawsuit filed by Rose Law. Rose Law filed the lawsuit for six professional fire sprinkler fitters against their former employer in June. Aero did not send letters to the six plaintiffs represented by Rose Law. The letters obtained by Rose Law include payroll checks for overdue unpaid wages, but require the workers to waive all possible claims against Aero and promise not to sue, even for claims the workers may not be unaware of, to cash their paychecks.

"This is a common defense ploy to pay-off class members cheaply before they opt in to receive full payment under the class action lawsuit," said Joe Rose, one of the attorneys representing the fire sprinkler fitters in their lawsuit. "The courts sometimes allow this under limited circumstances. But, i is a misdemeanor under California law to condition payment of unpaid wages admittedly owed to workers' on their promise not to sue, or to waive their right to the full amount," said Rose.



Rose Law alleges the workers were denied payment under the California Labor Code of minimum prevailing wages, overtime wages, travel, daily subsistence, health and welfare payments for work on at least four large commercial construction projects. Rose Law also alleges the workers were denied mandatory rest periods, and Aero failed to employ apprentice fire sprinkler fitters on California public works projects, including the Veterans Home in Fresno, Center for Science in San Luis Obispo, and on private projects including Los Robles Hospital Medical Center, and San Jose Regional Medical Center.
