United States : Goodwin Procter Wins for ZTE in ITC Patent Case [TendersInfo (India)]


(TendersInfo (India) Via Acquire Media NewsEdge) Goodwin litigators recently won a complete victory for clients ZTE Corporation and ZTE (USA) Inc. when the U.S. International Trade Commission (ITC) ruled in favor of ZTE in a patent challenge by FlashPoint Technology, Inc. ZTE is the sixth-ranked mobile phone maker in the world based on market share, and is a significant player in the U.S. no-contract phone market.



FlashPoint Technology, which widely licenses its patents to the digital camera and mobile device industry, asserted two patents against ZTE s mobile phones, which have digital cameras.

In its opinion, the ITC affirmed the finding that ZTE did not violate Section 337 of the Tariff Act of 1930, as amended (19 U.S.C. § 1337). The ITC upheld the administrative law judge s initial finding that ZTE s mobile phones did not infringe either patent and affirmed that FlashPoint failed to prove the alleged domestic industry practiced the patents.
