The soccer legend claims he was axed unfairly by the communications giant in December 2002 after a row over irregular payments. But, as a preliminary matter, the tribunalmust establish Mr Slaven's employment status and failed to reach a decision yesterday. Ntl says Mr Slaven, who started working as a presenter for them in February 1998, was self-employed on a freelance basis and this was written in his contract. But Mr Slaven'solicitor, Kevin McKernan claims ntl treated him as a permanent employee in many ways. Jackson, two, was playing in his garden when his head became stuck fast in the railings of the gate. FREED: Jackson Mahoney, two, of Kingston Road on the Tilery estate in Stockton, after he was freed by firefighters when he got his head stuck between the railings on his garden gate Picture: IAN McINTYRE His mum Leianne who had popped around the corner to see her mother on Stockton's Tilery estate raced home after his babysitter told her what had happened. These included giving him holiday and sick pay, the fact that he worked continuously for them from 1998 and that he was paid three months notice after his contract was terminated. There, she and Leianne's neighbour had tried and failed to free the distressed toddler. But Simon Goldberg, for ntl, said Mr Slaven'signed contracts stated he was not an employee of the company. They gave him a biscuit to try to calm him down -but firefighters had him out in no time -by bending the bars apart. Ntl's programme manager at Stockton Adam Nolan joined the company in April, 2000 when Mr Slaven was working as a guest presenter on Boro TV. Two fire engines were called to the house at Kingston Road at on Monday at 2pm -but although Jackson loves fire engines he was too upset to take notice. Now his mum wants the council to look at the safety of the gates on the estate. He said: "At no stage did Bernie regard himself as an employee and we had no obligation to give him work. "Another little girl got stuck by her legs. They are dangerous for young children because the gaps are just he right size for them to get stuck. "He never gave his services to the company on an exclusive basis." Mr Slaven's position was terminated when he failed to turn up for a programme at ntl on December 5, 2002 because he had not been paid. "I think the council should look at changing them after this. There area lot of young children round here," said Leianne, 23, who also has a son Charlie, four, and daughter Sophie, seven months. "When I received the phone call and they told me I was sacked I said 'sack thewages clerk, notme'," he said. Elaine Corney, chief executive of Tristar Homes, said: "This isn't a common occurrence and it is unfortunate when something like this happens and we do hope the child is all right. The tribunal is expected to reach a decision in the next few weeks. "We would urge parents to warn children of what can happen if they try to squeeze through railings while playing and urge parents to supervise young children."
