Linda man pleads not guilty to shovel attack


Jun 12, 2013 (Appeal-Democrat - McClatchy-Tribune Information Services via COMTEX) -- An 80-year-old Linda man pleaded not guilty on Tuesday to smashing his 72-year-old co-worker in the head with a shovel.

Speaking through a Spanish interpreter, Rudolfo F. Mosqueda denied striking Eugenio Acosta during a drunken argument on Saturday evening, according to Yuba County Superior Court records.

"They had both been drinking and that may have been a factor," Yuba County Undersheriff Jerry Read said.

Mosqueda believed Acosta had been making disparaging remarks about Mosqueda to their boss, Read said.

The fight started around 5:30 p.m. at a migrant workers camp in the 800 block of Brophy Road.

Acosta was transported to Rideout Memorial Hospital and received at least 17 sutures on his left cheek and ear, the Sheriff's Department said.

Acosta was not listed as a patient on Tuesday afternoon, a hospital official said.

The Yuba County District Attorney's Office charged Mosqueda with a felony count of assault with a deadly weapon and special allegations that could land Mosqueda in state prison, if convicted.

Yuba County Superior Court Judge Julia L. Scrogin ordered Mosqueda to return to court June 14 and scheduled a preliminary hearing for June 21.


The judge also increased Mosqueda's bail from $30,000 to $80,000, authorities said.

Mosqueda was still in custody Tuesday evening at the Yuba County Jail.
