Intuitive Surgical sent out a notification on May 8, 2013, to hospitals and other customers regarding "a potential issue" with the da Vinci surgical robot. The alert revealed that some models of the da Vinci monopolar curved scissors have "micro-cracks" in them that can create "a pathway for electrosurgical energy to leak into tissue during use and potentially cause thermal injury." The notification also revealed, in bold type, that the "micro-cracks may not be visible to the user." Intuitive's alert was issued in the face of an ongoing lawsuit against the medical device maker, titled the Estate of Fred E. Taylor v. Intuitive Surgical, 09-2-03136-5, Superior Court, State of Washington, Kitsap County (Port Orchard). It alleges the company failed to properly train surgeon Scott Bildsten, who performed a robotic prostate removal on Mr. Taylor, who died - allegedly as a result of the procedure - four years later, Bloomberg reported on May 8, 2013. The trial is in its fourth week. Intuitive's da Vinci system is currently the only approved robotic surgical device for use on soft tissue in the United States. According to the May 8 Bloomberg report, Taylor's lawsuit is the first of at least 26 cases against Intuitive over injuries allegedly caused by the robot. The da Vinci robot is also facing critics from other corners. According to a report in the Missoulian on April 16, 2013, the U.S. Food and Drug Administration (FDA) is looking into a spike in reported problems based on a survey the regulator gave to surgeons using the device earlier this year. The agency conducts these kinds of medical device surveys routinely, according to the Missoulian, but an FDA spokeswoman told the newspaper that the reason for it now has to do with "the increase in number of reports received," about the da Vinci. At least five deaths have been included in reports filed about the da Vinci since early last year, the newspaper reported.
