InvenSense® Provides Legal Matters Update


(Thomson Reuters ONE Via Acquire Media NewsEdge) SUNNYVALE, Calif., May 15, 2013 - InvenSense, Inc. (NYSE: INVN), the leading provider of MotionTracking((TM)) devices, today provided an update regarding certain legal matters.

Today InvenSense announced that on May 14, 2013 it brought a legal suit against ST Microelectronics, Inc. (NYST: STM) in federal court in Marshall, Texas. In the lawsuit InvenSense alleges that ST Microelectronics infringes 3 of its patents and seeks to prevent ST's unauthorized use of InvenSense intellectual property and asks that money damages be awarded to InvenSense. The complaint filed with the court includes diagrams which visually indicate clear infringement of InvenSense intellectual property patents by ST Microelectronics.

InvenSense has been the recognized technology leader for its series of world first innovations, including: * 2005: World's first dual-axis gyroscope * 2009: World's first three-axis gyroscope * 2011: World's first integrated 6-axis motion sensing product, with a 3-axis gyroscope and 3-axis accelerometer on the same die * 2012: World's first 9-axis motion-sensing product including a 3-axis compass in the same package as a 3-axis gyroscope and 3-axis accelerometer on the same die ST Microelectronics, Inc. did not develop a two-axis gyroscope for this market until 2009 and its three-axis gyroscope until 2010. InvenSense continues to innovate sensor technology with the first integrated six-axis gyroscope and accelerometer products introduced in 2011.

Historically, one year ago, on May 16, 2012, ST Microelectronics, Inc. (NYST: STM) elected to pursue a litigation based approach to resolving Intellectual Property matters between the two companies. On that date, ST filed a complaint in the Northern District of California alleging that InvenSense infringes 9 of its patents.


All of ST`s claims asserted in that initial litigation are subject to USPTO reexamination proceedings. To date, the USPTO has determined that substantial questions of patentability exist for eight of the nine patents asserted by ST and has issued office actions rejecting ST`s asserted claims in four of the patent reexamination requests. In view of the pending USPTO reexaminations, the United States District Court for Northern California stayed the initial litigation brought by ST.

On March 12, 2013, despite the findings of the USPTO and the action of the federal district court in the first case initiated by ST, almost a year later, ST filed a new complaint with the International Trade Commission (ITC) with respect to three of the same patents it asserted in the initial federal district court case, all three of which patents are currently being re-examined by the USPTO. The claims associated with two of the three ST patents from the prior case, now in the ITC case, have already been rejected by the USPTO in initial office actions. ST is also asserting two additional patents that were not in the initial federal court litigation.  InvenSense has reviewed the claims of the two additional patents asserted by ST in the ITC matter, and considers ST`s new patent claims to be wholly without merit.  InvenSense is defending itself vigorously before the ITC and has filed requests for inter partes review citing prior art references for each of the two additional patents-in-suit with the USPTO.

"ST did not enter the consumer MEMS gyroscope market until 2008, when it tried to catch up to InvenSense and target the growing consumer electronics market.
