Yarbrough Law Group Trade Secret Theft Lawsuit Triggers Federal Conviction


DALLAS, March 19, 2013 /PRNewswire via COMTEX/ -- A trade secret theft lawsuit filed by Yarbrough Law Group PC founder Matthew Yarbrough of Dallas has led to a criminal conviction for a Plano, Texas, executive based on federal felony computer hacking charges.



On March 1, 2013, a Dallas federal court jury convicted Michael Musacchio, 61, of conspiracy related to the hacking of the computer network for Exel Transportation Services, where he once served as president.

Court documents say Mr. Musacchio and others hacked Exel's computers so they could direct Exel's clients to Frisco, Texas-based Total Transportation Services LLC, where Mr. Musacchio and his affiliates had recently been hired. Mr. Musacchio was found guilty of one felony count of conspiracy to make unauthorized access to a protected computer (hacking) and two substantive felony counts of computer hacking. Each conviction carries a maximum statutory penalty of five years in federal prison and a $250,000 fine.

Key evidence amassed by Mr. Yarbrough included email communications between Mr. Musacchio and fellow former Exel Transportation Services employee Joseph Roy Brown, who pleaded guilty to related charges in 2011. In one email exchange, Musacchio asked Brown, "Now the next question is, how are we going to get into email after you leave " To which, Brown replied, "Not a problem ...
