BRIEF: Hartshorne man sentenced after stealing cash from fast food joint


MCALESTER, Dec 17, 2012 (McAlester News-Capital - McClatchy-Tribune Information Services via COMTEX) -- A Hartshorne man was recently sentenced for stealing cash from a local fast food restaurant.

Phillip J. Smith, 22, of Hartshorne, pleaded guilty Nov. 30 in Pittsburg County District Court to charges of conspiracy to commit a felony and grand larceny. He was fined $1,200 and sentenced to five years, with all but the first 40 days suspended.



Smith's co-defendant in the case, Heath Pitts, 36, of Hartshorne, pleaded guilty May to charges of conspiracy to commit a felony and grand larceny. On June 8, he received a five-year sentence, with all but the first 45 days suspended.

According to court records, Pitts and Smith stole $2,318.37 from the Hartshorne Sonic drive-in restaurant. When police arrived on the scene, both men were gone, however, according to court records, police were able to identify one of the men on the surveillance video footage. When police interviewed the one suspect, he then named the other as his accomplice in the theft.
