Crash and tips lead to car theft suspects [Gloucester Daily Times, Mass.]


(Gloucester Daily Times (MA) Via Acquire Media NewsEdge) July 30--ROCKPORT -- Two teens, suspected in car breaks and motor vehicle thefts in Greater Boston, were arrested here after a car crash, a search and a struggle between one and several officers, police said Friday.



Shortly before 8 a.m. Thursday, 17-year-old Michael Foley, of 262 Crescent St., Waltham, lost control of the red Chevrolet Blazer he was driving and struck a telephone pole near a Sandy Bay Terrace apartment complex. He continued driving the severely mangled vehicle down the road, parked it in one of the complex's handicap spots, and fled with a male passenger, police said.

Police quickly determined the vehicle had been reported stolen from Walpole earlier that morning.


Witnesses at the scene told police the two men ran off and were hiding behind a shed near the complex's building one.

Officers searching the area came upon David J. Weinstein, 19, of 94 Adams St., apt. 415, Waltham, who, upon seeing he was surrounded, voluntarily surrendered.

A little girl playing outside informed Sgt. Timothy Frithsen that another man wearing a white T-shirt had just run behind the complex's building seven. Officers found Foley sitting on a back deck. When asked what he was doing, Foley told police he lived in unit 716 -- a unit, police say, that doesn't exist.

By the time police took Foley into custody, more than a half dozen officers had responded to the scene, including Sgt. Mark Schmink, who was off duty. The manpower was needed, police said, as it took several officers to handcuff and restrain the "highly combative" teen.

Foley was lying on the ground, kicking his feet and swinging his arms, while officers attempted to cuff him, according to police.

"He was shouting profanities and degrading and threatening the officers," Patrolman Michael Soares noted in his report. "Officers were trying to control Foley's flailing limbs while he was continually striking them in his attempt to flee." As officers escorted Foley to a cruiser, he continued to resist by "digging his feet" into the ground. Once at the cruiser, Foley abruptly attempted to pull away and then charged toward Schmink and Sgt. Michael Marino, Soares noted.

"You don't know who you're messing with," Foley reportedly said during the scuffle. "I'm from Boston." Soares added that during the short ride to the station, Foley repeatedly banged his head against the cruiser's protective Plexiglass shield, injuring himself.

Let out of the cruiser and led into the police station for booking, Foley was able to pull away from the officers. According to the report, he then charged at them, kicking them several times and lunging his head forward in an attempt to "head butt" them. Foley's "aggressive actions" knocked himself and the officers to the ground, Soares wrote in his report.

According to Registry of Motor Vehicles records, Foley does not have a license and his right to drive has been suspended.

Foley was charged with receiving a stolen motor vehicle; operating a motor vehicle with a suspended license; two counts of resisting arrest; four counts of assault and battery on a police officer; and leaving the scene of an accident.

Police found an iPod, a Tom-Tom brand GPS device, and a plastic box full of change in Weinstein's possession.

Weinstein faces charges of receiving a stolen vehicle, leaving the scene of an accident, and three counts of larceny from a motor vehicle.

According to police, Foley and Weinstein are also wanted in connection to numerous car break-ins and motor vehicle thefts in Norwood and Waltham.

Both teens have pending cases in two other courts, police added.

Foley was arraigned and ordered held on $5,000 bail in Gloucester District Court on Thursday. Weinstein was ordered held on $1,500 bail. The teens were transported to Middleton Jail and were due back in court Friday for a dangerousness hearing, police said.

The owner of the stolen Blazer was notified and arranged for the vehicle to be towed back to Walpole.

No serious injuries to police officers were reported as a result of the arrests.
