Settlement With YouSwoop, Chicago Charity Wins


Chicago, Ill., Mar 08, 2010 (PRNewsChannel.com via COMTEX) -- A potential class action lawsuit against YouSwoop by Chicago resident Matt Parsons reached an amicable agreement today. YouSwoop sells certificates redeemable at a variety of merchants by sending an e-mail advertisement to a list of subscribers offering big savings through purchasing the certificates that it sells. Rather than wait for a lawsuit to be filed, YouSwoops own CEO, Alexander Lurie, agreed to sit down with Mr. Parsons attorneys, Jay Edelson and Bill Gray of Edelson McGuire, LLC to discuss the potential lawsuit.



Following the meeting, Lurie explained: We want every single one of our subscribers to be happy and we dont want anyone to think that we are not in full compliance with the law. Although admitting it is unconventional to sit down with a group leading a potential class action lawsuit, Lurie explained that the advantage of creating a new business is that he doesnt always have to follow conventional thinking. I wanted to demonstrate that we stand behind our product and was taking it on faith that Mr. Parsons and his lawyers were well-intentioned; they certainly were.

Jay Edelson, the managing partner of Edelson McGuire, LLC similarly commended YouSwoop and Lurie. A lot of companies try to stand behind $1,000 an hour lawyers and technical legal arguments. YouSwoop decided, instead, to stand behind its customers.


Under the terms of the settlement, YouSwoop will ensure that its model allows that consumers will obtain value from its certificates for five years from the purchase date. Additionally, for those limited subscribers whose certificates may have expired, YouSwoop agreed to make sure those subscribers get value from the same for a period of five (5) years past the issue date, or even to provide credits or refunds to those few consumers if requested. YouSwoop will also be making a charitable contribution to CARA, a non-profit organization that helps homeless people develop job skills. Edelson McGuire will be making a matching contribution to a non-profit charity that runs a child-care center for low-income Chicagoans.

Both Mr. Parsons and Edelson McGuire agreed to waive any compensation for themselves. YouSwoop demonstrated to us that they are committed to consumer protection ideals. Given the transparency and integrity they displayed, as well as their willingness to immediately fix the problems we identified, we were pleased to waive any fees to which we might have been entitled, explained Bill Gray.
