OSHA fines company for Webb Building death

(Buffalo News, The (NY) (KRT) Via Thomson Dialog NewsEdge) May 22--OSHA has fined David Burke Construction $49,000 for "extreme" work safety violations that were present when Jonathan Fundalinski fell to his death while working on the Webb Building in downtown Buffalo on March 20.



The U.S. Occupational Safety and Health Administration announced Tuesday that it found no guardrails or safety nets were present at the time of the fall, or safety harnesses that would have prevented Fundalinski's death.

"This case is the most extreme and unfortunate example of what can and does happen when fall protection is not used," OSHA area director Arthur Dube said in a statement.



The Hamburg company has 15 days to dispute the agency's finding.

Fundalinski fell 30 feet through a hole for a stairwell while working on rehabbing the building at 90 Pearl St.
