Fios and Nexidia Partner to Extend Discovery of Voice Recordings

Strategic partnership to integrate Nexidia’s unique technology for uploading, searching and analyzing recorded audio with Fios’ comprehensive electronic discovery services

PORTLAND, Ore. and ATLANTA – October 16, 2006 – Fios® Inc., a leading electronic discovery services provider, and Nexidia, the developer and provider of the most effective phonetic-based technology for audio search, today announced a strategic partnership designed to help clients more effectively and efficiently review and analyze electronic audio files as part of discovery. The two companies are extending Nexidia’s phonetic audio search technologies with Fios’ extensive electronic discovery services to provide clients with an innovative and cost-effective approach to manage complex litigation and regulatory compliance matters.

“Effectively accessing, analyzing and producing electronically stored audio files as part of discovery has become the newest challenge for today’s enterprises,” said Gerald Massey, president and CEO of Fios Inc. “Making this process easier to navigate and manage is part of Fios’ continued commitment to delivering comprehensive electronic discovery services enabled by leading technology. We’re extremely pleased to be extending our capabilities with Nexidia.”

Nexidia’s technology allows for highly scalable audio search by identifying phoneme (speech) patterns that provide higher accuracy than dictionary dependent, speech-to-text based audio search; manual transcription; or labor-intensive listening. This audio technology, combined with Fios’ proven evidence collection, processing, review, production and project management services, delivers a defensible process for integrating audio files in complex e-discovery requests.

“Due to increases in digital storage capacity and the arrival of digital voice recording and messaging systems, the quantity of sound recordings is growing rapidly. Tools that allow legal professionals to search and analyze these recordings are a critical element in the era of electronic discovery,” said John Willcutts, president and CEO of Nexidia. “Our eDiscovery OnDemand audio analysis, combined with Fios’ extensive electronic discovery services, provides the legal community with unmatched speed, accuracy and sophisticated analytics solutions combined with deep expertise in electronic discovery. We look forward to working with Fios to further expand our capabilities and meet this growing market demand.”

The ability to access, analyze and produce electronically stored audio files is becoming a necessity for organizations. According to a March 2006 Enterprise Communications survey by Forrester Research, companies that are in the initial rollout stage of adopting unified messaging systems have more than doubled over the past year. In addition, new amendments to the Federal Rules of Civil Procedure (FRCP) are scheduled to go into effect on December 1, 2006, and will clearly expand the types of data that will be discoverable.

“The current practice of producing e-mail, word processing documents and spreadsheets as part of discovery is changing and will now require preservation and production of all electronically stored information, including sound recordings,” said Mary Mack, Esq., technology counsel at Fios. “Having a legally defensible process for reviewing and producing the large amounts of electronic audio files will become vital for today’s highly litigious and regulated enterprises.”
