United States Patent Office Upholds Visto's Patent Claims Against Seven Networks


REDWOOD SHORES, Calif., March 3 /PRNewswire/ -- Visto Corporation, a leading global provider of secure push email, today announced that the United States Patent & Trademark Office has upheld a majority of the claims contained within Visto's U.S. Patent No. 6,085,192 in the re-examination of that patent requested by Seven Networks, Inc.


After considering Seven's request and assessing the merits of the patent, the Patent Office determined in its first office action that at least 15 of the patent's 25 claims are valid. This includes the claims at issue in Visto's ongoing patent infringement litigation against Seven in federal district court in Marshall, Texas.
Daniel Mendez, vice president and CTO of Visto Corporation, commented on the office action: "This issue has been distorted by Seven in an apparent attempt to confuse the market with a desperate press release that ignores the real facts in the case. Our suit against Seven involves a broad portfolio of intellectual property rights misappropriated by Seven, including infringement of 4 patents. Those patents have over 122 claims. However, infringement of just one claim is all that is required for Visto to win its case. Now that the Patent Office has already upheld the validity of 15 of Visto's claims, Visto is one step closer to prevailing before the jury this July in Texas."
In addition, Visto expects the Patent Office to withdraw the rejection of the 10 remaining claims of the '192 patent once Visto has presented its own views in the re-examination. Because the Patent Office has already upheld Visto's claims on two separate occasions, the company anticipates the case will be even stronger once it goes to court in July.
"Seven's blatant infringement of Visto's intellectual property will be adjudicated in a few short weeks," added Mendez. "Their request for re- examination of our patents has backfired as it is now clear that the claims will emerge with a second seal of approval from the Patent Office. Misappropriation, in this country, is not innovation and we expect our claims will be upheld."
