Lieff Cabraser Announces Court Approval of Moldy Washer Settlement; Deadline for Consumers to Claim Cash Is Fast-Approaching


On September 23, 2016, the United States District Court for the Northern District of Ohio granted final approval to a class action settlement for owners of certain front-loading Whirlpool, Sears, and Maytag washing machines. The litigation involves allegations that the washing machines, sold from 2001 to 2010, develop mold or odor. Consumers whose washers developed mold or odor are entitled to file a claim to receive between $50 and $500 cash, or choose a credit towards the purchase of a new washer. U.S. District Judge Christopher A. Boyko found the settlement to be "fair, reasonable, adequate, and in the best interest of the class."

The deadline is fast-approaching for consumers to file a claim: the claims period ends October 11, 2016. Owners of the affected washers should visit www.washersettlement.com for more information and to file a claim.

Whirlpool, Kenmore, and Maytag Front-Load Washer Settlement

Owners of washers included in the Settlement who experienced a mold or odor problem with their machine may qualify for a $50 cash payment, a cash rebate of 20% off the best negotiated purchase price of a new washer, or reimbursement of up to $500 for out-of-pocket expenses incurred in addressing mold or odor issues or replacing their washer due to mold or odor. Owners of washers who did not experience a mold or odor problem with their machine qualify for a cash rebate of 5% off the best negotiated purchase price of a new washer or dryer, or both. An estimated 5.5 million eligible washers were sold during the relevant period, 2001-2010.

All claims under the Whirlpool/Sears/Maytag settlement must be submitted by October 11, 2016.

LG Front-Load Washer Settlement

There is a separate class action settlement for owners of certain LG brand front-loading washers made between January 1, 2002 and December 31, 2006. Owners of LG washers included in the Settlement may choose a $35 cash payment or a $105 rebate on the best negotiated purchase price of a new washer. An estimated 700-800,000 LG washers were sold during the relevant period. The deadline to submit a claim for LG owners is October 10th. LG owners should visit www.lgwashersettlement.com for more information and to submit a claim.


All claims under the LG settlement must be submitted by October 10, 2016.
