(Targeted News Service Via Acquire Media NewsEdge) FERC Issues Order Approving Revised Exhibits Re Jersey Central Power & Light Company and PSEG Fossil, LLC's Yards Creek Pumped Storage Hydroelectric Project Under P-2309 WASHINGTON, Nov. 3 -- The U.S. Department of Energy's Federal Energy Regulatory Commission issued the text of the following delegated order: Jersey Central Power & Light Company PSEG Fossil, LLC Project No. 2309-027 ORDER APPROVING REVISED EXHIBITS (Issued November 3, 2014) 1. On August 2, 2013, and supplemented on October 15, 2014, Jersey Central Power & Light Company and PSEG Fossil, LLC, licensees for the Yards Creek Pumped Storage Hydroelectric Project, FERC Project No. 2309, filed revised exhibits pursuant to Articles 203 and 204 of an Order Issuing New License (License). The project is located on Yards Creek, in the Townships of Hardwick and Blairstown, Warren County, New Jersey. The project does not occupy any federal lands.



Background 2. Article 203 states within 90 days of issuance, the licensees shall file, for Commission approval, a revised section 2.2.2 of Exhibit A to incorporate the revised emergency spillway design concept and Exhibit F drawings on sheets 4, 6, 7, and 8 that clearly show the authorized flashboards and the authorized emergency horseshoe spillway. The Exhibit F drawings must comply with 18 C.F.R. sections 4.39 and 4.41 of the Commission's regulations.

3. Article 204 states within 90 days of issuance, the licensees shall file, for Commission approval, a revised Exhibit G drawing that identifies and encloses, within the project boundary, all principal project works necessary for operation and maintenance of the project, including the 500-foot-long single 230-kilovolt transmission line from the project switchyard to the Kittatinny substation, the Visitor Center, the Lower Overlook Site, the access road to the Kaiser Trailhead, and the Kaiser Trailhead (including the parking area). The Exhibit G drawing must comply with sections 4.39 and 4.41 of the Commission's regulations.


4. On August 2, 2013, and supplemented on October 15, 2014, the licensees filed the revised exhibits and stated only Exhibit F Drawings F-7 and F-8 had to be revised to show the flashboards and emergency spillway design. In addition, the licensees stated that Exhibit G Drawing's Project boundary includes the existing recreation facilities including the Visitor Center and Lower Overlook site. It also includes the transmission line from the Project powerhouse to the Kittatinny substation.

Review A. Revised As-Built Exhibit A 5. We reviewed the revised Exhibit A, and found it accurately describes the project facilities. The revised Exhibit A properly incorporates the authorized flashboards and revised emergency spillway design in section 2.2.2. The revised exhibit conforms to the Commission's rules and regulations, and is approved in ordering paragraph (A) of this order. In ordering paragraph (B) we revise the project description to reflect the changes to the project. However, we are repeating the entirety of the project description for purposes of consistency and recordkeeping.

B. Revised As-Built Exhibit F Drawings 6. We reviewed the revised Exhibit F drawings and found they incorporate the necessary project features. The revised exhibits clearly show the authorized flashboards and the authorized emergency horseshoe spillway. The revised exhibits conform to the Commission's rules and regulations, and are approved, as shown in ordering paragraph (C) of this order. In addition, since the Exhibit F Drawings F-4 and F-6 filed on February 18, 2011 did not need revisions, they will also be approved at this time. In ordering paragraph (D), we are requiring the licensees to file the approved drawings in an electronic file format.

C. Revised As-Built Exhibit G Drawings 7. Commission staff reviewed the revised Exhibit G drawing and found it accurately shows all principal works necessary for operation and maintenance of the project, including the 500-foot-long single 230-kilovolt transmission line from the project switchyard to the Kittatinny substation, the Visitor Center, the Lower Overlook Site, the access road to the Kaiser Trailhead, and the Kaiser Trailhead (including the parking area). We georeferenced the Exhibit G drawing and found it in agreement with our current mapping requirements. The revised exhibit conforms to the Commission's rules and regulations, and is approved by this order. In the licensees filed in its supplemental filing, project boundary GIS data for Commission approval. Commission staff reviewed the GIS project boundary data and found it acceptable. However, we are requiring the licensees to file two separate sets of the project boundary GIS data on compact disks with the Commission for recordkeeping purposes. The GIS data files should include the date of the order. In ordering paragraph (D) we are requiring the licensees to file the approved drawings in an electronic file format.

The Director orders: (A) The revised Exhibit A, filed August 2, 2013, describing the Yards Creek Pumped Storage Hydroelectric Project, is approved and made a part of the license. The previous Exhibit A is eliminated from the license.

(B) The project description, line item (22), of the Yards Creek Pumped Storage Hydroelectric Project, under ordering paragraph (B)(2) of the license, is revised to read as follows: (2) Project works consisting of: (1) a lower reservoir with a maximum usable storage capacity of 5,324 acre-feet; (2) a main, earthfill dam at the lower reservoir that is 1,404 feet long and 52 feet high; (3) an auxiliary dike at the lower reservoir that is 2,091 feet long and 35 feet high; (4) a concrete uncontrolled spillway with 12-inch-high flashboards; (5) an auxiliary reservoir with seasonal storage of 412 acre-feet formed by the auxiliary reservoir dam, which is 1,000 feet long and 20 feet high; (6) an upper reservoir with a maximum usable storage capacity of 5,090 acre-feet; (7) a main, rockfill dam (north dam) at the upper reservoir with a maximum height of 70 feet and three dikes (east, west, and southwest) totaling approximately 8,900 feet long including the space between the dikes; (8) a rockfill east dike at the upper reservoir, which is 21 feet high and 2,582 feet long; (9) a rockfill west dike at the upper reservoir, which is 52 feet high and 1,978 feet long; (10) a rockfill southwest dike at the upper reservoir, which is 25 feet high and 593 feet long; (11) a 2,116-foot-long, 35-foot-wide intake channel in the floor of the upper reservoir; (12) a 95-foot-high concrete intake structure with trashracks and stop logs; (13) an emergency spillway structure at the upper reservoir; (14) an 1,130-foot-long, 20-foot-diameter concrete-lined pressure tunnel; (15) a 210-foot-long, 19-foot-diameter steel-lined pressure tunnel; (16) a 144-foot-long, 19-foot-diameter concrete encased steel-lined transition section; (17) a 478-foot-long, 19-foot-diameter steel penstock connected to a 1,582-foot-long, 18-foot-diameter steel penstock by an 8-foot-long reducer section; (18) a 325-foot-long trifurcated penstock, one penstock per pumping-generating unit that tapers from 10-foot-diameter to 7-foot 2.5-inch-diameter; (19) 86.5-inch spherical guard valves at the entrance to each pump-turbine spiral case; (20) three vertical shaft, Francis-type, reversible pump-turbine engine units, each with an authorized installed capacity of 121.5 megawatts (MW) at 730 feet of net head for a total installed capacity of 364.5 MW; (21) a 140-foot-long by 63.5-foot-wide underground concrete powerhouse; (22) the 500-foot-long single 230-kilovolt transmission line from the project switchyard to the Kittatinny substation; and (23) appurtenant facilities.

(C) The following exhibit drawings, filed on February 18, 2011 and August 2, 2013, conform to the Commission's rules and regulations, and are approved, and made a part of the license.

a) Digital images of the approved exhibit drawing shall be prepared in electronic format. Prior to preparing the digital image, the FERC Project-Drawing Number (i.e., P-2309-1008) shall be shown in the margin below the title block of the approved drawing. Exhibit F drawings must be segregated from other project exhibits, and identified as (CEII) material under 18 C.F.R. section388.113(c). Each drawing must be a separate electronic file, and the file name shall include: FERC Project-Drawing Number, FERC Exhibit, Drawing Title, date of this order, and file extension in the following format [P-2309-1008, F-4, Lower Reservoir Main Dam Plan & Profile, MM-DD-YYYY.TIF].

Each Exhibit G drawing that includes the project boundary must contain a minimum of three known reference points (i.e., latitude and longitude coordinates, or state plane coordinates). The points must be arranged in a triangular format for GIS georeferencing the project boundary drawing to the polygon data, and must be based on a standard map coordinate system. The spatial reference for the drawing (i.e., map projection, map datum, and units of measurement) must be identified on the drawing and each reference point must be labeled. In addition, each project boundary drawing must be stamped by a registered land surveyor. All digital images of the exhibit drawings shall meet the following format specification: IMAGERY: black & white raster file FILE TYPE: Tagged Image File Format, (TIFF) CCITT T.6 (CCITT Group 4 fax encoding) RESOLUTION: 300 dpi desired, (All drawing fonts must be legible) SIZE FORMAT: 22" x 34" (min), 24" x 36" (max) FILE SIZE: less than 1 MB desired b) The licensees shall file two separate sets of the project boundary GIS data on compact disks with the Secretary of the Commission, ATTN: OEP/DHAC. The data shall be in a georeferenced electronic file format (such as ArcView shape files, GeoMedia files, MapInfo files, or a similar GIS format). The filing shall include both polygon data and all reference points shown on the individual project boundary drawings. An electronic boundary polygon data file(s) is required for each project development. Depending on the electronic file format, the polygon and point data can be included in single files with multiple layers. The georeferenced electronic boundary data file must be positionally accurate to a40 feet in order to comply with National Map Accuracy Standards for maps at a 1:24,000 scale. The file name(s) shall include: FERC Project Number, data description, date of this order, and file extension in the following format [P-2309, boundary polygon/or point data, MM-DD-YYYY.SHP]. The filing must be accompanied by a separate text file describing the spatial reference for the georeferenced data: map projection used (i.e., UTM, State Plane, Decimal Degrees, etc.), the map datum (i.e., North American 27, North American 83, etc.), and the units of measurement (i.e., feet, meters, miles, etc.). The text file name shall include: FERC Project Number, data description, date of this order, and file extension in the following format [P-2309, project boundary metadata, MM-DD-YYYY.TXT].

(E) This order constitutes final agency action. Any party may file a request for rehearing of this order within 30 days from the date of its issuance, as provided in section 313(a) of the Federal Power Act, 16 U.S.C. section 825l (2012), and the Commission's regulations at 18 C.F.R. section 385.713 (2014). The filing of a request for rehearing does not operate as a stay of the effective date of this order, or of any other date specified in this order. The licensees' failure to file a request for rehearing shall constitute acceptance of this order.
