Bracewell Wins Dismissal for Dr. Alexander Mirtchev and Krull Corporation


Bracewell & Giuliani LLP and Sale & Quinn PC successfully defend Dr. Alexander Mirtchev and Krull Corporation in Hourani v. Mirtchev in the U.S. Court of Appeals for the D.C. Circuit. In the July 31, 2015 decision, the Court's Opinion affirmed the District Court's dismissal of the Houranis' complaint with prejudice.

We are pleased with the July 31, 2015 decision by the Court of Appeals affirming the dismissal with prejudice of the Houranis' amended complaint. This is the latest in three consecutive rebukes of the Houranis' attempts to abuse U.S. courts by filing malicious complaints. These complaints were part of the failed legal harassment, PR and lobbying campaign formerly led by the Houranis' relative, the late former Kazakhstan KGB (now KNB) Major General Rakhat Aliyev, who was the source of the fabricated documents that were the foundation of the case, the negative PR information, and the campaign.

The Houranis' failed claims relied on ontradictions, which U.S. District Court Judge Hogan found "difficult to accept." The campaign and court case were predicated on forgeries and fabrications, exposed by leading international expert document examiners. In the District Court's dismissal with prejudice of the Houranis' complaint, Judge Hogan noted that "the critical (if not sole) piece of evidence" on which it relied has been challenged "as a forgery upon which Plaintiffs claim to no longer rely." We applaud the fact that the Court's decision today ensures that these plaintiffs cannot continue to misuse U.S. laws and U.S. courts to pursue this failed harassment campaign.



The failed campaign has targeted various prominent individuals, ranging from heads of state, presidents, prime ministers and royalty, to members of the executive and legislative branches in the U.S. and other Western countries. Our client, Dr. Alexander Mirtchev, who is one of the targets of this campaign, is an academic, macroeconomic advisor, and author. He is a Senior Scholar, Founding Council Member of the Kissinger Institute on China and the United States at the Woodrow Wilson Center, Vice President of the Royal United Services Institute for Defence and Security Studies, London, and Board Director and Executive Committee Member of the Atlantic Council of the United States.
