inthinc Announces Texas Court Grants Temporary Restraining Order Against Mix Telematics North America, Inc. in Unfair Competition Lawsuit

(Marketwire Via Acquire Media NewsEdge) SALT LAKE CITY, UT -- (Marketwired) -- 08/12/14 -- inthinc Technology Solutions, Inc., a global telematics company centered on fleet management and driver safety solutions, today announced that a Texas Court, on June 12, 2014, granted a Temporary Restraining Order against Mix Telematics North America, Inc., enjoining and restraining various activities of Mix, Charles "Skip" Kinford, CEO of Mix, and other persons acting in concert or participation with them, pending a full trial for damages and permanent injunction expected later this year or early next.

The Order was issued in a lawsuit pending in State Court in Texas (inthinc Technology Solutions, Inc. v. Mix Telematics North America, Inc., Cause No. 048-272569-14, in the 48th Judicial District Court, Tarrant County, Texas). A related lawsuit is pending in Federal Court in Utah (inthinc Technology Solutions, Inc. v. Kinford, Cause No. 2:14-CV-00428-CW-PMW, in the United States District Court, District of Utah), which will be consolidated later this week into the Texas Court by agreement of the parties.

The lawsuits filed by inthinc allege multiple counts of breach of contract, interference with contracts and business relations, and misappropriation of trade secrets, among other things. The consolidated Texas lawsuit will include causes of action against Kinford and Mix related to Kinford's alleged breaches of fiduciary duty while still employed by inthinc.

"We were shocked to discover that Kinford has apparently breached his contractual and fiduciary obligations to inthinc, and that he and Mix apparently have engaged in unfair and anti-competitive activities, including misappropriation of inthinc's valuable trade secrets," said Todd Follmer, CEO of inthinc Technology Solutions.
