McDonald's Lawsuit Filed for Cyclospora from Salad by Attorneys Brendan Flaherty and Ryan OsterholmA lawsuit against McDonald's Corporation has been filed on behalf of K.C., who was diagnosed with a Cyclospora infection after eating a salad at a McDonald's restaurant. The lawsuit was filed July 17, 2018, in the Circuit Court of Cook County, Illinois (case number 2018L007378) by attorneys Brendan Flaherty and Ryan Osterholm. "Cyclospora symptoms, including severe diarrhea, can last several months or longer," said attorney Brendan Flaherty, a national food safety lawyer. "We are alleging that our client contracted Cyclospora infections from Southwestern Chicken Salad sold by a McDonald's restaurant in Carterville, Illinois. We believe that this outbreak, including our client's illness, could have and should have been prevented." The lawsuit alleges Plaintiff K.C. regularly ordered Southwest Chicken Salad, a McDonald's menu item containing lettuce and other leafy greens, fro the McDonald's located at 400 E. Plaza Drive, Carterville, Illinois. On June 25, 2018, Plaintiff K. C. started to feel sick, suffering nausea, stomach pain, headache and diarrhea, all symptoms of Cyclospora food poisoning. A stool culture tested positive for Cyclospora, a parasite that causes severe gastroenteritis in humans called cyclosporiasis. Symptoms of cyclosporiasis include watery diarrhea, loss of appetite, cramping, nausea, fatigue, fever, dehydration and weight loss. The Illinois Department of Health (IDH) confirmed that K.C. was part of the multi-state outbreak of Cyclospora caused by contaminated salad produced and sold by certain McDonald's restaurants, according to the lawsuit. According to documents filed in this case, in late June of 2018, IDH and the CDC identified a spike in the number of cyclosporiasis cases in Illinois. Public health investigators soon identified salads sold at Defendant McDonald's restaurants as the likely source of the illnesses. As of July 13, 2018, the CDC had identified 61 Cyclospora outbreak cases in seven states: Illinois, Iowa, Minnesota, Missouri, Nebraska, South Dakota and Wisconsin.
