Mintz Levin Secures Another IPR Victory on Behalf of Straight Path IP Group, Inc.


Straight Path and Mintz Levin (News - Alert) have once again leveraged their historic IPR appellate victory into further success before the U.S. Patent Trial & Appeal Board, which has ruled in patent owner Straight Path's favor in eight Inter Partes Reviews challenging the validity of three Straight Path patents. Straight Path's "point-to-point protocol" patents have now outlasted an array of IPR challenges filed by LG, Samsung (News - Alert), Cisco and others, opening the door for Straight Path to resume its pending district court actions against these and other defendants.

In a consolidated final written decision issued May 9, 2016, PTAB determined that petitioners LG, Toshiba, Vizio, Hulu, Cisco, Avaya (News - Alert), and Verizon failed to prove the unpatentability of all challenged claims of Straight Path's U.S. Patent No. 6,108,704, ten of the eleven challenged claims of its Patent No. 6,131,121 patent, and seven of the ten challenged claims of Patent No. 6,009,469. (IPR2015-00196, -00198, -00209, -01397, -01398, -01400, -01406, -01407.) Straight Path was represented by Mintz Levin in each of the IPRs.

These victories come on the heels of Mintz Levin and Straight Path's recent victory at the Federal Circuit in Sipnet EU S.R.O. v. Straight Path IP Group, Inc., IPR2013-00246 (PTAB), in which PTAB had determined that the challenged claims of Straight Path's '704 patent were unpatentable. Straight Path retained Mintz Levin to appeal that adverse Sipnet IPR decision, and on appeal Mintz Levin and Sraight Path convinced the Federal Circuit to reverse and remand the Sipnet IPR decision in its entirety, the first time a patent owner achieved such a victory before the Federal Circuit.



Straight Path's appeal victory already has led to victories in six Inter Partes Reviews filed by Cisco (News - Alert), Avaya, and Samsung. PTAB's decision in the remanded Sipnet IPR is imminent and will resolve the last IPR pending against these Straight Path patents.
