According to the lawsuit, throughout the Class Period defendants issued false and misleading statements to investors and/or failed to disclose that: (1) one of Freshpet's material customers, Target (News - Alert) Corp., was delaying the installation of a significant number of Freshpet Fridges because it was undergoing a corporate reorganization; (2) it was likely that any Freshpet Fridges located in two of Freshpet's supermarket customers would soon be removed for they were experiencing financial hardships; and (3) as a result, Freshpet's public statements were materially false and misleading at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages.
