IVC Blood Clot Filter Lawsuits: Lieff Cabraser Provides Answers to Injured Patients

Wendy R. Fleishman of the national plaintiffs' law firm Lieff Cabraser Heimann & Bernstein, LLP, announces that the firm has published an informational video on IVC blood clot filter injuries and a list of Answers to Frequently Asked Questions About IVC Blood Filters concerning alleged defects in certain retrievable inferior vena cava (IVC) blood filters.

Each year, tens of thousands of patients in the U.S. are implanted with retrievable IVC filters, including patients who have undergone gastric bypass surgery, bariatric surgery, or other types of major surgery. "We wanted to provide patients implanted with IVC filters with clear, concise answers to their questions, including why the devices may cause serious, even fatal, injuries. The FDA has warned about the use of these devices and we wanted patients and their families to be aware of their legal rights," stated Fleishman.

The questions answered include:

  • What are the risks associated with permanent IVC filters?
  • What are the risks associated with temporary IVC filters?
  • Has the FDA receied many reports of dangerous complications associated with temporary IVC filters?
  • What should I be concerned about if I get a temporary IVC filter?
  • Is an IVC filter a reasonable risk for me, is there something less invasive my doctors can do if I am at risk for blood clots?
  • If the temporary IVC filter breaks, what can happen to my body?
  • If the temporary IVC filter's legs or parts break apart, then what happens to it?
  • If serious medical complications result from a broken IVC filter, who is responsible for my medical bills, lost wages, and pain and suffering?

"Temporary IVC filters are intended to be taken out as soon as the doctor believes the risk for a pulmonary embolism or clot in the lungs has passed," Fleishman noted. "The FDA has warned that these filters should be used for short-term use, meaning one or two months. If a temporary IVC filter stays in the vessel leading to the heart for too long, it can lead to dangerous, even fatal, complications. In lawsuits against C.R. Bard, for example, patients and their loved ones have charged that temporary IVC filters the Recovery or the G2 (News - Alert) migrated or fractured and perforated a blood vessel or the heart itself. The patients in those lawsuits claim that the device manufacturer knew or should have been aware of these risks, but failed to warn the patients and their doctors. The patients claim that because the risk of fracture or migration was so high, the manufacturer is responsible for the injuries the patients suffered."
