AppDynamics Announces Settlement of Litigation with CA, Inc.


AppDynamics today announced that it has entered into a mutual settlement agreement with CA (News - Alert), Inc., that resolves all pending litigation between them, including a patent case that CA brought against AppDynamics in the United States District Court for the Eastern District of New York, and a declaratory judgment action that AppDynamics brought against CA in California.

In 2013, CA brought a patent infringement action against AppDynamics in the United States District Court for the Eastern District of New York. As AppDynamics stated from the start and argued to the court in that case, AppDynamics' products never infringed CA's patents. As part of the settlement agreement, AppDynamics obtained, for a modest fixed payment, not only a full release of all claims arising from, or relating to, the patents asserted in the case, but also an irrevocable, perpetual license to those patents and other related foreign or domestic patents. The parties have now resolved all of their disputes regarding these patents and notified the court of their settlement agreement.

In 2014, AppDynamics sought a declaratory judgment from the United States District Court for the Northern District of California, stating, among other things, that AppDynamics and its executives did not misappropriate trade secrets from CA and did not use any CA source code in AppDynamics' products. In connection with that case, CA performed an examination of AppDynamics' source code, and CA has now acknowledged that AppDynamics did not misappropriate any source code technical trade secrets, and further acknowledged that no sourcecode written for CA products was incorporated into AppDynamics' products. Additionally, as part of the settlement agreement, AppDynamics obtained a full release of all claims arising from, or relating to, the facts and circumstances giving rise to the case. AppDynamics did not make any payment to CA in exchange for the settlement of the California action and the acknowledgment CA provided in connection with that case. The parties have now resolved all of their disputes regarding the California claims and notified the court of their settlement agreement.
