Court Cancels Bail for Attack Suspect

(AllAfrica Via Acquire Media NewsEdge) THE state's application to cancel bond awarded to a man charged with the Mpeketoni killings was on Friday granted by a Mombasa High court.

Judge Edward Muriithi informed Dyana Suleiman that although he had the right to be released on bond, the issue of the public interest in national security and public safety is a compelling reason to deny him the bond. "When national security and public safety are threatened, the very existence of the open and democratic and civilised society is also jeopardised," Muriithi said.

He said there must be proper balance between individual rights and the rights of the society. Muriithi however said that Suleiman still enjoys the right to be presumed innocent until proven guilty by evidence tabled by the prosecution. "Considering the continuing attacks in Lamu and Tana River county, the prosecution is on point to allege that, if the accused is released on bail, he might get an opportunity to organise more attacks," he said.

The judge also said that, in the interest of justice for the accused, the court will fast-truck his case. "I consider that it is in the interest of justice for both the accused and the public that the criminal prosecution of the accused be conducted expeditiously," Muriithi said. On July 10, the DPP requested Muriithi to review orders releasing Suleiman on Sh500,000 bond.
