Insist on fair deal for faulty phones [Sunday Mirror (England)]
(Sunday Mirror (England) Via Acquire Media NewsEdge) Have you taken on a new iPhone or similar smartphone recently and, if so, did you agree a two-year contract so that you could get the handset for free? It might seem like a great deal but you could be in for a shock. You have entered a two-year legal agreement to use your free phone that only has a one-year warranty. This means that if the phone stops working after the warranty period you will have no phone to use but will still be locked in to the two-year deal.
When you call the provider to ask for a new phone they might say you have to pay for it as the old phone is out of warranty!
But there is good news. The Sale of Goods Act clearly says that all goods must be 'fit for purpose' and of 'satisfactory quality'. If the provider sells you a two-year contract and a phone to use, the phone can only be fit for purpose if it lasts for the full contract duration. Tell the provider this when they try to sell you a new phone.
