BRIEF: Misdemeanor charge dropped against Rep. Larry Womble

Nov 26, 2012 (News & Record - McClatchy-Tribune Information Services via COMTEX) -- WINSTON-SALEM -- Prosecutors have dropped charges against state Rep. Larry Womble for his role in a fatal car crash late last year.

The Winston-Salem Journal reported today that the N.C. Attorney General's Office dropped a misdemeanor death by motor vehicle charge against Womble because it did not believe it could prove its case beyond a reasonable doubt.

Womble, 71, was seriously injured in the Dec. 2 head-on crash that killed David Allen Carmichael, 54, a Winston-Salem waiter and bartender.

Witnesses told police that Womble veered into Carmichael's lane on Reynolds Park Road. But Womble's attorney told the newspaper that investigators later found that Carmichael appeared to be the one who crossed the center line. Carmichael's blood alcohol level was three times the legal limit.

Womble, a Forsyth County Democrat, served nine terms in the N.C. House. He did not seek re-election this month.
