Apple files countersuit against Creative(UPI Entertainment News Via Thomson Dialog NewsEdge)Apple Computer Inc., creator of the iPod, has filed a countersuit against Creative Labs Inc., escalating a legal battle between the two digital companies. Creative, the No. 2 seller of digital MP3 players in the world, sued Apple in U.S. District Court in Northern California last month, The Washington Post reported. Creative accuses Apple of patent infringement. Apple filed a countersuit in U.S. District Court in Western Wisconsin, and followed that up last week with a claim in Eastern Texas. Apple claims Creative infringed on a number of its patents relating to software and systems. Creative had sought amicable solutions with Apple in the last few months, the newspaper said. At no time during these discussions or at any other time did Apple mention to us the patents it raised in its lawsuits, we had fully anticipated and planned for Apple's retaliatory action, said Creative spokesman Phil O'Shaughnessy told the Post. |
