VoIP Provider Appeals FCC VoIP E911 Order

Nuvio Corp. announced today that it is appealing the Federal Communication Commission's (FCC) order that requires interconnected Voice over Internet Protocol (VoIP) service providers to make E911 available to all of their customers by Nov. 28.



Because of the relatively short period of time before the FCC's deadline, Nuvio - which operates a large VoIP network and offers VoIP services - requested that the U.S. Court of Appeals for the District of Columbia expedite the appeal in hopes of quickly obtaining a decision.

According to the statement, Nuvio CEO Jason Talley said that if a decision has not been reached by Nov. 7, then the company faces dire consequences.


"Absent that, and with the lack of direction currently given by the FCC, we will have no choice but to start suspending some users," Talley said in a prepared statement. "Our users are primarily small to medium-sized businesses, and we have to be able to notify them in advance of any service interruption."

Talley said that the 120-day deadline imposed by the FCC is "arbitrary and capricious," noting that wireless companies had "decades" to provide E911 service "and are far from completion."
