Pfizer sues Dainippon Sumitomo Pharma in Britain+
(Japan Economic Newswire Via Thomson Dialog NewsEdge)TOKYO, Jan. 25_(Kyodo) _ Dainippon Sumitomo Pharma Co. said Wednesday that Pfizer Ltd. has filed a lawsuit against it and its parent firm Sumitomo Chemical Co. with a British court.
Pfizer is calling on both firms to return all data concerning a hypertension drug licensed by the U.S. firm and demanding cessation of its production and marketing by Dainippon, the Japanese drugmaker said.
Pfizer claims the licensing agreement is no longer effective on the grounds that Sumitomo Pharmaceuticals Co., which was the licensee, no longer exists following its merger with Dainippon Pharmaceutical Co. to create Dainippon Sumitomo Pharma last October.
The court battle involves Amlodin, a high blood pressure therapeutic drug that is also used to treat angina pectoris. The rights as the licensee were transferred to Sumitomo Chemical at the time of the merger, according to Dainippon.
The two corporate defendants contend that the British court has no jurisdiction on the matter and that even if the court decided to adjudicate in the dispute, the licensing agreement would be found to remain in force.
The outcome of the litigation therefore would have no negative effect on the Japanese companies' businesses, according to Dainippon.
The claim made by Pfizer is essentially the same as that being made in a similar lawsuit filed in Japan, Dainippon added.
