Myron M. Cherry & Associates, LLC and Romanucci & Blandin, LLC File a Class Action Lawsuit against the City of Chicago for Violating Due Process in Automated Speed and Traffic Law Enforcement Violations

Myron M. Cherry & Associates, LLC and Romanucci & Blandin, LLC have filed a suit on behalf of three individual plaintiffs and a class of similarly affected individuals against the City of Chicago for its illegal practice of issuing notices for alleged automated speed and traffic law enforcement violations. The complaint sites a failure to properly specify the make of the vehicle and, more significantly, that the City has ignored its own requirement to send a second notice to alleged offenders before determining liability. As a direct result, according to the lawsuit, the City has collected fines and penalties from Plaintiffs and class members to which it was not entitled.

"The City's failure to abide by the Municipal Code of Chicago and the Illinois Vehicle Code renders all automated speed and traffic law enforcement citations defective, unconstitutional and void. By failing to follow Illinois law and its own municipal code, the City has deprived individuals of proper notice and due process in connection with its operation of speed and red light cameras. The City nonetheless continues to demand and collect payments from individuals without proper due process and for violation notices that were not executed according to the City's own prescribed process," noted Jacie C. "Te city's unconstitutional practice, including the collection of fines and penalties from drivers is an outrage to tax paying, law-abiding citizens. As a result of this practice, these individuals have been subject to vehicle seizure, driver's license revocation and have suffered other harm and inconveniences," noted Antonio M. In addition to seeking the recoupment of alleged unlawful and unconstitutional fines and penalties collected by the City, the lawsuit also seeks to enjoin the City from initiating collection actions, seizing vehicles or otherwise enforcing the improper violation notices.
