MERRILL LYNCH INVESTIGATION INITIATED BY FORMER LOUISIANA ATTORNEY GENERAL: Kahn Swick & Foti, LLC Investigates Merrill Lynch on Behalf of Purchasers of Strategic Return Notes


Former Attorney General of Louisiana, Charles C. Foti, Jr., Esq., a partner at the law firm of Kahn Swick & Foti, LLC ("KSF"), announces that KSF has commenced an investigation on behalf of purchasers of Merrill Lynch Strategic Return Notes.

On June 21, 2016, the Wall Street Journal reported that the Securities and Exchange Commission is expected to file a civil enforcement case against Merrill over sales and marketing practices involving structured notes that lost 95% of their value. Merrill sold over $150 million worth of the notes, known as Strategic Return Notes, in 2010. The Notes were linked to Merrill's proprietary volatility index and came with roll costs of 12% of the principal in the first half of 2011 and 4% in the second half. Merrill's brokers were allegedly never told about the high roll costs associated with the Notes.

Then, on June23, 2016, the Financial Industry Regulatory Authority (FINRA) announced that it has fined Merrill $5 million for negligent disclosure failures in connection with the sale of the Notes.



KSF's investigation is focusing on whether Merrill Lynch violated state or federal laws.
