Iraq war veteran faces up to year in jail for groping 13-year-old girl in Daly City

REDWOOD CITY, Nov 07, 2009 (San Mateo County Times - McClatchy-Tribune Information Services via COMTEX) -- A 25-year-old Iraq war veteran is facing up to a year in jail for groping the 13-year-old daughter of a Daly City woman he met through an Internet pen pal Web site for military personnel, authorities said Friday.



Adolfo Hernandez of Carrizo Springs, Texas was initially facing up to 20 years in prison on three counts of lewd and lascivious conduct with a child under the age of 14, as well as a count of sending harmful matter and a charge of communicating with a minor to commit lewd and lascivious acts. All but one charge was dropped as part of a deal with prosecutors, Assistant District Attorney Karen Guidotti said.

He pleaded no contest to lewd and lascivious conduct and is set to be sentenced Nov. 29. With credit for time already served he will probably spend another six months in jail, Guidotti added.


Prosecutor Jennifer Ow said Hernandez met the girl's 38-year-old mother through a Web site while serving in Iraq and then a relationship began to develop. When he returned to the U.S. he came to visit them at their home in Daly City. But one day, while the mother was at work, Hernandez put his hand up the girl's shirt and down her pants while fondling her, prosecutors said. She didn't immediately tell her mother what happened and Hernandez was sent back to Iraq not long after.

The man, however, kept corresponding with the girl via text message and eventually convinced her to send a photo of herself topless to him, prosecutors say. In turn, he allegedly sent a naked photo of himself to her. The mother eventually discovered the messages, including the photos, and called police.

Hernandez's attorney, David Cohen, did not immediately respond Friday to a phone message and an e-mail.

Hernandez remains in custody in lieu of $300,000 bail.
