ENTANET: Entanet Asks 'Is Mandelson The New Master Of The Digital Economy?'

In the latest article on its opinion website, (http://opinion.enta.net), leading communications provider Entanet asks if Secretary of State Peter Mandelson has become the new master of the digital economy.
In the article, Darren Farnden, Head of Marketing at Entanet, points out that the new Digital Economy Bill, as expected, calls on ISPs to monitor the activities of users who allegedly infringe copyright. The ISP will also be required to send written warnings to alleged offenders and provide information on request to the copyright holders. In Entanet's view, the process identified for doing this is fundamentally flawed as it relies on identifying illegal file sharers by IP address and there is a high potential for incorrect allegations being made.
If this activity fails to reduce file sharing significantly the government has vowed that further 'technical' action may be taken. What exactly this will involve - or when it will be introduced - is yet to be made clear. Entanet's concern here is that the Secretary of State could decide to impose stringent and restrictive rules without sufficient warning or consultation with ISPs and that this will result in many innocent companies and users being unfairly impacted upon.
Farnden says in the piece: "Whilst I understand the benefits that this would bring for copyright holders and the need to react quickly I am concerned that this basically results in Mandelson et al being able to change the law as and when they feel necessary without the Lords or MPs being able to block the move. I thought Britain was a democracy! Maybe using the past tense is correct."
He goes on to call for a more considered approach to be taken that takes in the views of all stakeholders and in particular, ISPs and their customers. "In our view the concept of allowing an individual with their own political agenda the power to amend the law as and when they deem necessary is ridiculous and needs rethinking completely."
