ANTI-COMPETITIVE PRACTICES TOP COMPLAINTS AGAINST REALTY PLAYERS


(Indian Business Insight Via Acquire Media NewsEdge) The data from the Competition Commission of India (CCI) shows that the anti-competitive practices and abuse of dominance topped the list of complaints against real estate companies lodged with the regulator. According to CCI, as many as 150 complaints were received against these aspects. Even though, most of the real estate companies resort to 'collective dominance' by incorporating biased abusive clauses in their 'builder-buyer' agreements. But, CCI's hands are tied as it can implement its model agreement only on a single dominant player. This is because, the Competition Act 2002, as interpreted by CCI and Competition Appellate Tribunal does not identify the concept of 'collective dominance'.
