Accused gang member's mental state being considered in murder case

HAMPTON, Feb 14, 2012 (Daily Press - McClatchy-Tribune Information Services via COMTEX) -- The mental competency of an accused gang member is being raised in a Hampton murder case.

During a hearing Monday Hampton Circuit Judge Louis Lerner said that a doctor couldn't determine Shavis Holloman's competency during a recent evaluation. Lerner said the doctor thought Holloman "was a malingerer." Holloman, 29, is charged with 13 felonies including two counts of first-degree murder. The evaluation was to determine if Holloman is competent to stand trial. The attorney's in the case agreed that Holloman should be evaluated and restored to competency at Central State Hospital.

David Holt, senior assistant commonwealth's attorney said the decision was, "in the interest of caution and fairness." Holloman, of Newport News, is charged in connection with the Aug. 2010 shooting death of Thomas Needam III and the July 2010 death of Wynton Thomas. Holloman's charges include robbery, racketeering, gang participation, malicious wounding and firearms charges.

Last week a jury convicted Jamel Carney, 23, of first-degree murder and 13 other felonies in Needam's murder. Carney was sentenced to 203 years in prison. During Carney's trial several witnesses testified that Holloman was the leader of the Nine Trey Gangstas, a bloods gang based out of Harbor Square apartments. In a statement to police read during the trial, Carney said Holloman was the one who shot Needam.

Holloman's next court appearance is scheduled for April.
