9th Circuit Court Defends RMO LLP's "High Quality" Attorneys

A 9th Circuit panel has not only defended but also praised litigators at RMO LLP.

In its 16-page decision published Nov. 21 (No. 18-55779), the panel ordered River Springs Charter Schools to pay $45,621 in attorneys' fees to RMO over its representation of C.Q., a female student at Prentice School in Santa Ana. Prentice had challenged the attorney-fee request on several grounds, including that the hourly rates claimed by RMO litigator David Greco were unreasonable - which the Ninth Circuit disputed.

"The evidence supports his rates," the court wrote. "Greco's credentials and reputation, the complex issues in the litigation, the high quality of is work product, and the excellent result are factors that confirm that hourly rates of $365, $400, and $425 are reasonable for the representation that he provided in this appeal."

Representatives at RMO said they were delighted with the Ninth Circuit - who also characterized RMO's answering brief as "well-written, concise, and aptly discusses the applicable law, facts, procedural history and issues on appeal."

"The Ninth Circuit can obviously distinguish between costly representation and quality representation," said Scott Rahn, managing and founding partner of RMO. "This assures future special-needs clients that they can get aggressive representation because the Ninth Circuit won't question attorney fees commensurate with a high-quality work product."

Greco, who graduated magna cum laude from University of San Diego School of Law, where he is a guest lecturer, said the decision is a win for the client and for all students. "I'm thrilled, proud and pleased to have my work commended by the Ninth Circuit and even more thrilled that I could deliver this work product to C.Q.'s family," Greco said.
