RIM Good News: Company Wins Appeal in Mformation Patent Dispute

In a change of its recent luck, Research In Motion has scored a recent legal victory in a patent dispute with Mformation (News - Alert).



A California judge recently overturned a jury finding which would have required RIM to pay $147.2 million in damages, according to a report from The Wall Street Journal. Back in July, the jury had concluded that RIM infringed on the intellectual property of Mformation Technologies.

Mformation, which manufactures mobile-device-management software, claimed that RIM infringed on its patents since 2008.

"RIM did not infringe on Mformation's patent and we are pleased with this victory," Steve Zipperstein, a RIM lawyer, said in a company statement.

Mformation could appeal the judge's ruling, which could lead the way to a new trial if Mformation is successful.

There was some other good news this week for RIM – albeit temporary.

RIM shares increased some 10 percent early Wednesday after Jefferies & Co. analyst Peter Misek said RIM may license its new operating system to Samsung (News - Alert) Electronics, according to Reuters. He says RIM could license BlackBerry (News - Alert) 10, which is now being developed. Other analysts, however, disputed his prediction, and on Thursday Samsung said it is not considering acquiring RIM or licensing BlackBerry 10, Reuters said.

Meanwhile, RIM still is struggling as it fights its rivals for market share, TMCnet reported. RIM saw its market share in the United States fall from 44 percent in 2009 to just 10 percent in 2011, the AP revealed. Apple (News - Alert), Samsung and HTC are among its chief rivals for market share.

As far as the future, RIM’s “turnaround” hinges on the success of the BlackBerry 10, which won’t be released until 2013.

The company’s 1Q loss totaled $518 million, according to a company statement. An additional 5,000 employees will lose their jobs, according to TechZone360.

In other recent news, The Toronto Star reported that RIM may close some of its company-owned North American retail stores. Details about 3,000 layoffs may soon be released.
