Court Rules Against School Graduation Ban over Facebook Photos

By Joe Eitel, TMCnet Contributing Writer

A Philippine court overturned a disciplinary action by a Catholic school for photos on Facebook of five female students wearing bikinis. The school had originally barred the five students from attending the school’s graduation ceremonies.

The Times of India reported the girls broke a rule in the student handbook prohibiting students from posting Internet pictures showing “ample body exposure.” A lawyer representing the school told reporters “In order to maintain the morality of the school there were rules and regulations issued to the students."

Judge Wilfredo Navarro issued a restraining order against St. Theresa’s College High School in Cebu City. He stated the decision by the school to ban these students was “un-Christian” and “unlawful.”

The court case stemmed from a petition by one of the 16-year-old girls’ mothers, stating the girl had suffered “sleepless nights” since the school disciplinary action. Her lawyer said the ruling in favor of the girls attending graduation applied to all five students. The girl and her mother also sought unspecified damages in the civil suit.

Staff at the high school declined comment on the matter but disagree with the ruling. According to the Associated Press, the school asked the court to reconsider its ruling.

The Facebook photos in question reportedly show one girl holding a cigarette and liquor bottle, and the other photos depict the girls in bikinis at a beach party.
