TruePosition Claims Courtroom Victory against Andrew Corporation

TruePosition ( News - Alert), Inc., a provider of wireless location solutions and a subsidiary of Liberty Media Corporation, today announced that the United States Delaware District Court issued a permanent injunction against Andrew Corporation, a division of CommScope, Inc. The injunction prohibits Andrew Corporation from making, using, selling or offering to sell control channel Uplink Time Difference of Arrival location technology, company officials say.
The court also ruled against Andrew Corporation on each of its post-trial motions. The Andrew Corporation also lost on each issue that the court reserved for decision, including certain allegations regarding TruePosition’s actions at ETSI ( News - Alert), the European standards body, company officials say. The case is TruePosition, Inc. v. Andrew Corporation.
In relation to prior sales of control channel U-TDOA location technology that Andrew made to the Saudi Telephone Company, or STC, the court awarded damages in the amount of $18.6 million, officials say.
That amount is increased to $23.25 million as Andrew has willfully infringed upon TruePosition’s technologies, says a press release from TruePosition. Following a two-week trial of the case last September, the court remitted damages for future lost profits that the jury awarded to TruePosition while making this award. For some of the patents not involved in the present case, TruePosition has already obtained a settlement from Andrew Corporation worth $42 million. The prior case is TruePosition, Inc. ( News - Alert), v. Allen Telecom, Inc.
TruePosition says it’s the largest company solely dedicated to location-based safety and security solutions in the world. Holding more than 40 U.S. patents in wireless location technology and more than 100 patents abroad, the company’s technology is deployed nationwide in the United States and is used to locate wireless subscribers who dial 911. TruePosition location solutions include Cell ID, Enhanced Cell ID, Angle of Arrival, Uplink Time Difference of Arrival, and Assisted GPS.
“This is a major win for TruePosition,” said Frederic Beckley, executive vice president and general counsel of TruePosition. “This decision not only affirms the value of our extensive patent portfolio, but also secures our position as the only provider of a crucial location technology.”
